Zur Regulierung von politischen und sozialen Konflikten werden Menschenrechte oft als normative Leitidee ins Spiel gebracht. Insbesondere in den letzten beiden Jahrzehnten hat sich gezeigt, wie heterogen die Aufgaben sind, zu deren Bewältigung Menschenrechte herangezogen werden: Sie reichen von der Bedrohung des internationalen Terrorismus über die kulturelle Identitätsbehauptung als Bestandteil sozialer Spannungen bis zu neuen Formen der Meinungsäußerung durch soziale Medien. Hinzu kommt, dass es auch die Menschenrechte selbst sind, die Konflikte auslösen oder vertiefen. Der Band versammelt Beiträge, die die Anwendungsrelevanz der Menschenrechte in Situationen des inner- und zwischenstaatlichen Widerstreits aus interdisziplinärer Perspektive diskutieren: Wie lösen Menschenrechte Kulturkämpfe aus und wie können diese mit ihnen beendet werden? Gibt es eine Pflicht zur humanitären Intervention? Unter welchen Bedingungen darf das Menschenrecht auf Meinungsäußerungsfreiheit eingeschränkt werden? Welche Prinzipien sind die normativen Grundlagen des internationalen Menschenrechtsregimes? Mit Blick auf solche Fragen zeigen die Autorinnen und Autoren die Relevanz von Menschenrechten im Konflikt auf und verdeutlichen, weswegen jene selbst Gegenstand des Konflikts sind. For the regulation of political and social conflicts, human rights are often brought into play as a normative guiding principle. Over the past two decades in particular, it has become apparent how heterogeneous the tasks that human rights are tackling, ranging from the threat of international terrorism to cultural identity assertion as a component of social tensions, to new forms of expression through social media. In addition, it is also the human rights themselves that trigger or deepen conflicts. The volume collects contributions that discuss the application relevance of human rights in situations of inter-state and inter-state conflict from an interdisciplinary perspective: How do human rights trigger cultural struggles and how can these be ended with them? Is there a duty to humanitarian intervention? Under what conditions should the human right to freedom of expression be restricted? What principles are the normative foundations of the international human rights regime? In view of such questions, the authors point out the relevance of human rights in conflict and make clear why they themselves are the subject of the conflict.
